Planning precedent report

RETENTION PERMISSION: Planning permission is sought for retention of the Garden of Eden Community Childcare Centre which was previously approved under planning permission ref 2499/09 with a condition which restricted the permission to 5 years. The applicant seeks to obtain retention permisson without such a restriction on the permission. The Garden of Eden Community Childcare Centre is located at St. Malachys Boys National School, Edenmore Park, Raheny, Dublin 5.

Planning permission for A. Two storey extension to side/rear B. All associated site works to side/rear.

Permission at Edenmore View Apartments Edenmore Avenue, Raheny, Dublin 5. The development will comprise; (i) the construction of 1 no. additional floor (649 sqm) over the existing 3 storey retail and apartment building, bringing it to 4 storeys in total. (ii) The new proposed third floor will accommodate 8 no. new apartments of 45-79sqm, comprising of 4 no. 1 bed apartments 2 no. studio apartments and 2 no. 2 bed apartments, all with balconies. (iii) Provision of new roof garden over south-east wing of proposed new third floor with stair-core & lift shaft brought up to roof garden also (iv) amendments to all elevations to accommodate these changes (v) minor internal amendments to existing second floor to accommodate the new proposed floor; and any ancillary necessary works to facilitate this development.

RETENTION PERMISSION: the development will consist of (i) retention permission is sought for change of use of part of the existing building from 13 no. student accommodation dwelling units (12x 2 beds & 1 x 1bed), 1 no. caretaker unit, 2 no. conference and common facilities units to 16 private residential units (12x 2 beds & 4x 1 beds), over first and second floor levels, (ii) retention permission is also sought for minor elevational differences compared to previously approve including the omission of timber panelling with aluminium box flashing window surrounds and replaced with brickworks.

Change of use from a retail outlet to a shop for the sale of hot food (pizza primarily, but also including kebabs) as well as cold non-alcoholic drinks and desserts, mainly for home delivery by the applicant company, with ancillary customer collection

Permission for change of use from existing retail unit to Pizza Takeaway, also erection of new signage to shop front.
