We, O’Flynn Construction Co. Unlimited Company intend to apply to Dublin City Council for permission for development at this site, part of the ‘Nissan Site’ (c.1.86 ha), to the east of Walkinstown Avenue at the junction of Walkinstown Avenue and Naas Road. The development will consist of amendments to a previously permitted (Reg. Ref. 3228/20, as amended by Reg. Ref. 3792/23) mixed-use development comprising part Build to Rent development. The development will consist of the following proposed modifications: I. Rationalisation of internal layouts and repurposing of common areas in Blocks I, J, K and L (no change to building heights or footprint), resulting in a total of 416 residential units (from 395 originally) as follows: a) Block I: Rationalisation of ground floor and eighth floor layouts resulting in 6 no. additional units, including 3 no. studio units and 3 no. 2-bedroom units; b) Block J: Rationalisation of ground floor and sixth floor layouts resulting in 3 no. additional units, including 2 no. studio units and 1 no. 2-bedroom unit; c) Block K: Repurposing of internal residential amenity area and adjacent rooftop terrace (external amenity area) at sixth floor level to provide 1 no. additional 3-bedroom unit, and an overall increase of 68 sq.m in the gross floor area (due to repurposing of the sixth-floor rooftop terrace); and d) Block L (Build to Rent): Repurposing of areas formerly designated as tenant amenities and support facilities at ground floor and sixth floor level, and a portion of the external rooftop amenity area at sixth floor level, resulting in 11 no. additional units, including 8 no. 1-bedroom units, 1 no. 2-bedroom unit and 2 no. 3-bedroom units, and an overall increase of 82 sq.m in the gross floor area (due to repurposing of rooftop amenity space). II. Permission is sought to omit the Build-to-Rent (BTR) designation of Block L thereby facilitating occupation by all tenures. III. Elevational changes to Blocks I, J, K and L, as follows: a) Ground-floor elevations of Blocks I, J, and L will be adapted to accommodate the proposed units, replacing curtain walls with windows and doors aligned with the upper-level fenestration, adding terraces, and resizing access openings; b) Upper-level elevations of Blocks I, J, K, and L will be revised, substituting curtain walls for fenestration that mirrors the levels below and incorporating balconies where required; and c) Inclusion of 9 additional terraces at ground-floor level and 67 additional balconies on upper levels (L01-L06) in Block L, ensuring compliance with private amenity space standards for apartment developments, to facilitate the proposed change in residential tenure. IV. Reconfiguration of 2 surface-level parallel car parking spaces and reallocation of public open space to provide 11 standard perpendicular parking bays along the accessway east of Block B, increasing the overall resident parking provision by 9 spaces in total. V. Provision of 32 additional long-stay bicycle storage spaces to serve the new residential units in Blocks I, J, K and L. VI. Communal open space for Blocks I and J (which remains greater than the required quantum) has been reduced to a cumulative total of 4,277 sq.m (from 4,287 sq.m) to facilitate the provision of additional cycle storage for residents. VII. Public open space (which remains greater than the required quantum) has been reduced to a cumulative total of 10,268 sq.m (from 10,389 sq.m) to accommodate 11 reconfigured surface-level car parking spaces as described in IV. VIII. Temporary permission (for the duration of planning permission) is sought for the erection of 2 no. advertising signs at the corner junctions of R112/R810 and R112/110.

Permission for development to construct a two-phase mixed-use residential and commercial scheme, which will consist of: the construction of a residential scheme arranged in 3 No. blocks (identified as Blocks A, B and C) ranging in height from 6 No. to 25 No. storeys over a double-level basement (with ancillary facilities); and an amendment to a previously-permitted 8-storey commercial block (that formed one of the three commercial blocks in permission Reg. Ref. DSDZ5296/22) identified as Block No. 3 over three levels of basement on a site of 1.24ha forming part of a larger site identified as City Block No. 9, North Wall Quay, Dublin 1. The subject site is primarily bounded by: Mayor Street Upper to the north; North Wall Quay to the south; North Wall Avenue to the east; and the residual City Block No. 9 lands of 0.69ha to the west. The Application relates to a proposed development within a Strategic Development Zone Planning Scheme area (North Lotts and Grand Canal Dock SDZ). For the purposes of identification, the Applicant references this proposal as Scheme No. 16. The earlier commercial permission (Reg. Ref. DSDZ5296/22), which this proposal seeks to amend in part, is referenced as Scheme No. 9. That commercial permission also included two other commercial blocks (Block Nos. 1 and 2), which are not affected by this proposal. (Block 2 is currently under construction.) (Scheme No. 9 amended earlier permissions: Scheme No. 7 (Reg. Ref. DSDZ2103/21); Scheme No. 6 (Reg. Ref. DSDZ3042/19); Scheme No. 5 (Reg. Ref. DSDZ3780/17); and Scheme No. 4 (Reg. Ref. DSDZ3779/17). Subsequentially, Scheme No. 9 was partially amended in relation to commercial Block No. 2 (only) by two mutually-exclusive Permissions: Scheme No. 10 (Reg. Ref. DSDZ4208/23); and Scheme No. 11 (Reg. Ref. DSDZ4408/23). Scheme No. 11 (Reg. Ref. DSDZ4408/23) was subsequentially amended by Scheme No. 14 (Reg. Ref. DSDZ3552/24).) A previous permission (Scheme No. 7 (Reg. Ref. DSDZ2103/21)) permitted the construction of a three-level basement structure beneath commercial Block Nos. 1, 2 and 3. Scheme No. 9 (Reg. Ref. DSDZ5296/22) permitted a three-level basement beneath commercial Block No. 2 while amending the basement structures beneath Block Nos. 1 and 3, from a single shared three-level basement with Block No. 2 to two separate two-level basements – abutting the three-level basement of Block No. 2. 1) The development will consist of the construction of new build and amendments to earlier permissions (as appropriate, with amendment of Scheme No. 6 (Reg. The lands are bound by the R121 and Hollywoodrath residential development to the east, the under construction Bellingsmore residential development to the south and north, the former Hollystown Golf Course to the north, Tyrrelstown Educate Together National School, St.Luke's National School and Tyrrelstown Community Centre to the west and south and the existing Tyrrelstown Local Centre to the south. The proposed development will consist of the development of 548 no. residential units, consisting of 147 apartments/duplexes and 401 houses, ranging in height from 2 to 5 storeys and including retail/café unit, 2 no. crèches, 1 no. Montessori, 1 no. community hub, car and bicycle parking, open space and public realm, over a site area of c. 25.3 ha, as follows: 1. On lands to the north of the application site (referred to as Sites 2 & 3) the proposed development includes for 428 no. houses and apartments comprising 27 No. 1-bed apartments, 97 No. 2-bed houses, 267 No. 3-bed houses and 37 No. 4-bed houses set out in 401 no. houses (373 no. 2-storey and 28 no. 3-storey) and 9 no. 3-storey apartment buildings (27 no.). A total of 792 no. car parking spaces will be provided for this part of the scheme, of these, 761 no. spaces will be provided for residents with 30 no. spaces provided as visitor parking and 1 no. space for disabled parking. In terms of bicycle parking, a total of 225 no. cycle parking spaces are provided, comprising 180 no. spaces for terraced units (located in 9 no. bike stores with 20 no. bikes in each) plus 45 no. spaces for the apartments. 2. On lands to the south of the application site and north of the Tyrrelstown Local Centre (referred to as Local Centre) the proposed development includes 120 no. apartment/duplex units in 4 no. blocks ranging in height from 3 to 5 storeys (32 no. 1 bedroom, 68 no. 2 bedroom and 20 no. 3 bedroom) all of which have balconies or terraces set out as follows: • Block A, is a 4 storey building, providing 12 no. units with proposed balconies, with a café/retail unit of 154sq.m and community hub of 144.5 sq.m proposed at ground floor. • Block B, is a 3-5 storey building, providing 34 no. units with proposed balconies and ground floor terraces. • Block C, is a 3-5 storey building, providing 44 no. units with proposed balconies and ground floor terraces. • Block D, is a 4 storey building, providing 30 no. units with proposed balconies and ground floor terraces, with a crèche of 500 sq.m with an external play space of 200 sq.m and a Montessori of 280.3 sq.m with an external play space of 185 sq.m proposed at ground floor. • External communal amenity space is provided at ground podiumterrace levels throughout the scheme. • A standalone 2-storey crèche unit is also provided of 529.6 sq.m with an external play space of 243 sq.m, to the south of the site. • Car Parking is provided in a mix of undercroft in Blocks B & C and at surface level with 108 spaces for residential use and 5 no. creche/Montessori staff spaces, 10 no. creche/Montessori set down spaces, 6 no. visitor spaces and 9 no. public spaces on the Link Street. A total of 300 no. bicycle parking spaces are proposed as part of the development comprising 230 no. long stay spaces for residents and 70 no. short stay spaces for both visitors and the non-residential activity. 3. Vehicular access to Sites 2 & 3 to the north of the application site is through the construction of a new vehicular entrance off Hollywoodrath Road (R121), a new footpath and cycle path along the northern and western side of the R121 along the site frontage extending south to the existing Toucan crossing facility over the R121, and provision of 2 no. new Toucan crossings on the R121 (c.0.53 ha) as well as via an extension to Hollystown Avenue link road south of the permitted Bellingsmore development. Vehicular access to the Local Centre to the south of the application site is via the existing access point along Hollystown Avenue and the north-south link route from the existing Tyrrelstown Local Centre which is partially completed and partially under construction. Pedestrian and cycle access is also provided along the R121, through existing roads within the application site and through the creation of a new pedestrian/cycle route to the north at the existing entrance to the clubhouse of the former Hollystown Golf Course. 4. The development of proposed Class 1 public open space of 2.77ha and Class 2 public open space of 1.69ha including pedestrian/cycle routes, seating areas, kick about area, playgrounds, dog park, associated landscaping works including planting, changes in level and boundary treatments. In addition 3.21 ha of linear park under the existing power lines and 2.11ha of ancillary linear open space which includes for SUDS and hedgerow features is provided in the scheme. The proposed Class 1 open space is provided as a north south pedestrian and cycle connection to the north an connecting the site to the Ratoath Road and the future Dublin GAA facilitites at this location. 5. The construction of a new foul outfall sewer, approx. 3km in length to connect to the existing 600mm diameter foul sewer to the south of Powerstown Road which will include decommissioning of the existing Pump House south of Hollystown Park. 6. The development will also provide for all associated ancillary site development infrastructure including landscaped areas and sustainable urban drainage systems under the existing ESB powerlines, and all associated ancillary site development infrastructure including: demolition of an existing shed, ESB sub-stations, public lighting, and foul and surface water drainage; internal roads & footpaths; landscaping; and all associated engineering and site works necessary to facilitate the development. The proposed scheme is designed to integrate with the previously permitted development at Bellinsgmore (Ref FW13A/0088/E1) which is currently under construction and recently permitted residential development on lands to the north east known as Site 1 (FCC Reg. Ref.: FW21A/0042). The application contains a statement setting out how the proposal will be consistent with the objectives of the Fingal County Development Plan 2017-2023 and the Kilmartin Local Area Plan 2013 (as extended). The application contains a statement indicating why permission should be granted for the proposed development, having regard to a consideration specified in section 37(2)(b) of the Planning and Development Act, 2000, as amended, notwithstanding that the proposed development materially contravenes the Fingal County Development Plan 2017-2023 and the Kilmartin Local Area Plan 2013 (as extended), other than in relation to the zoning of the land. Permission for the development. The proposed development will comprise: Amendments/ modifications to the permitted development on plot TC1 and associated basement Levels BM, B1 and B2 shared with TC2 and specifically Blocks B1, B2, B5 and B6 as permitted under the Cherrywood Town Centre development Reg. Ref. DZ17A/0862 (as modified by Reg. Refs. DZ18A/1058, DZ18A/1178 and DZ19A/0148) and includes the development of a new mixed use urban block, Blocks B3/ B4 and associated amendments at basement Levels BM, B1, B2 and provision of a new basement Level B3. No amendments/ modifications are proposed to the permitted Blocks A1, A2, A3 within TC1. The overall effect of the amendments/ modifications is to reconfigure the permitted block and basement layouts and adjoining streets and squares, amend the block elevations and increase the overall gross floor area (GFA) of the development permitted within TC1 from 72,675sq.m to 95,644sq.m including increase retail GFA from 17,541sq.m to 33,737sq.m, increase High Intensity Employment (HIE) GFA from 9,026sq.m to 9,610sq.m, increase non retail GFA from 12,632sq.m to 18,689sq.m. and increase community GFA from 1,400sq.m to 1,449sq.m The permitted number of residential units (365no.) within TC1 remains unchanged. Block B6 (5,264sq.m): Reconfiguration of previously permitted retail and non-retail units to provide 18no. retail units and associated ancillary areas totalling 2,732sq.m and 2no. non retail restaurant/ bar units of 200sq.m and ancillary areas of 154sq.m all at ground floor level, 2no. non retail leisure units of 1,542sq.m, 1no. retail unit of 561sq.m and associated ancillary areas totalling 75sq.m at Level 1 with associated external terrace areas. The reconfigured Block B6 will also incorporate a pedestrian link bridge to Block B2 at Level 1 revised lift/ stair cores and escalator arrangements and all associated elevational amendments. As previously permitted the pedestrian streets between Blocks B1 to B6 are covered by a building mounted glazed roof structure providing shelter to these areas. Amendments at roof level include the reconfiguration roof lights, solar panels, plant zones and green roof areas to Blocks B1, B2, B5 and B6. Terraces are provided within Blocks B1, B5 and B6. The basement footprints have been enlarged at all levels along Cherrywood Avenue and at Level B2 at the south eastern corner of TC 1. The basement layouts are revised to reconfigure and rationalise circulation, car and cycle parking, cycle parking facilities, vertical circulation, ventilation, service yards and routes and waste management facilities. A new basement Level 83 is proposed to accommodate plant and tenant facilities. The number of car parking spaces within TC1/ TC2 basements decreases from 2,986 to 2,977no. spaces. The number of cycle parking spaces within TC1/ TC2 increases from 1,643 to 1,880 spaces comprising 1,258 basement level spaces and 622 surface level spaces. Revised proposals are provided for access to basement level cycle parking spaces and facilities via 2no. pavilions on Civic Street with associated revisions to the hard and soft landscaping within this area. The car park accesses to the shared TC1/ TC2 basements from Tully Vale Road (left-in/ left-out), the entrance/ exit on Grand Parade and a dedicated service entrance from the Wyattville Link Road (WLR) are as previously permitted. The permitted entrance/ exit ramp from Cherrywood Avenue (WLR - J) is proposed to be amended by the addition of a footpath for emergency escape. The future pedestrian bridge connection from Level 1 of Block B2 over Wyattville Link Road (WLR) to Plot TC3 will be the subject of a separate future planning application. The support column within the WLR median for this future pedestrian bridge was permitted under Reg. Ref. DZ17A/0862 and remains unchanged. Permission is also sought for all ancillary uses and all site and development works associated with the above development including service infrastructure/ public utilities, internal streets and squares, Town Centre and shopfront signage, directional signage, stairs, lifts, escalators, travellators and all associated hard and soft landscaping.
