The site also has direct frontage to the Glenamuck District Distributor Road, which forms the north-west boundary. The development will consist of: i) Demolition of an existing dwelling and removal of a building ruin with a total combined area of 291sq.m; ii) Construction of 144 residential units: A) 70 apartments in a single block, 6-storeys in height, incorporating 35 no. 1-bed units and 35 no. 2-bed units, all with private amenity space in the form of ground level terraces or balconies at upper levels; B) 16 duplexes 3-storeys in height, including 8 no. 2-bed units and 8 no. 3-bed units, all with private amenity space at ground or first floor terraces; and C) 58 houses of 3-storeys in height, including 36 no. 3-bed townhouses and 22 no. 4-bed houses, all with private amenity space in the form of rear gardens and/or second-floor terraces; iii) Provision of c.5,015sq.m of public open space, and a communal amenity area of c.607sq.m; iv) Vehicular access to the development will be via the existing access at Glenamuck Road South, and vehicular access will be provided or facilitated to neighbouring properties east of the site; v) The provision of new pedestrian and cycle connections to Glenamuck Road South and the Glenamuck District Distributor Road, as well as a new pedestrian link to the adjoining Willow Glen estate to the east, with potential future pedestrian links to the west also facilitated; vi) A total of 318 bicycle parking spaces and 135 car parking spaces; vii) Provision of surface water attenuation, SuDS measures and connections to facilitate services including to the existing watermain at Glenamuck Road South and to the existing foul drainage network at the Glenamuck District Distributor Road; viii) All associated site and infrastructural works, inclusive of drainage and utilities infrastructure, ESB substation, bike and bin stores, hard and soft landscaping, boundary treatments, internal roads, cyclepaths and footpaths, and public lighting.
The Proposed development on a 0.586-hectare net site area comprising of: (i) Demolition of existing dwelling, comprising of a building of 399sq.m; (ii) Construction of 24 no. dwellings, consisting of 4 no. 2 bed units & 20 no. 3 bed units, comprised of 4 no. House Type A units, 13 no. House Type B1 units, 6 no. House Type B2 units & 1 no House Type B3 unit. The proposed dwellings are between 2 - 3 storey buildings, ranging in height from 9 metres to 11.5 metres; (iii) Provision of 41 surface car parking spaces, including visitor, accessible & EV charging spaces, 6 no. visitor bicycle parking spaces and 1 no. motorcycle space located around the site; (iv) Public open space areas of combined 1,005sqm or 17.1% of the site area; (v) Creation of an upgraded vehicular & pedestrian/cyclist entrance to link to the R842 Glenamuck Road; (vi) Infrastructure works to serve the proposed development to include the internal road network, public lighting, site drainage works, hard and soft landscaping, boundary treatment, and all ancillary site services and development works above and below ground.
The proposed development seeks to demolish existing outbuildings on site and provide for the construction of 157 no. residential units, a childcare facility with a GFA of 187.3 sq.m., associated internal roads, pedestrian and cycle paths, open space, and all associated site and infrastructural works. The residential component of the development consists of 66 no. apartments, 46 no. duplex / apartment units and 45 no. houses, to be provided as follows: 17 no. 1-bed apartments; 19 no. 2-bed apartments; 30 no. 3-bed apartments; 30 no. 2 bed duplex / apartment units; 16 no. 3 bed duplex / apartment units; 10 no. 3-bed (Type B1, B2, B3, C and D) houses; 35 no. 4-bed (Type A and A1) houses. The 66 no. apartments are provided within 2 no. apartment buildings (B.01 and B.02) of 5 no. storeys in height, with undercroft and surface car parking. The childcare facility is located at the ground floor of Building B.01. The 46 no. duplex / apartment units are provided in 2 no. 4 storey duplex / apartment buildings (D.01 and D.02) comprising 2 storey duplex units over ground and first floor apartment units, and 1 no. 3 storey duplex / apartment building (D.03) comprising 2 storey duplex units over ground floor apartment units. The houses consist of 2 and 3 storey terraced, semi-detached, and detached houses. The proposal contains a total of 218 no. car parking spaces, including 90 no. in-curtilage and surface level spaces for the houses, and 128 no. undercroft and surface level spaces for the duplex / apartment units, the apartments and the childcare facility, and 5 no. motorbike parking spaces for the apartments. The proposal contains 282 no. bicycle parking spaces for the duplex / apartment units, apartments and childcare facility, and 4 no. bicycle parking spaces for 2 no. mid-terraced houses. Cycle parking for all the other houses is provided in-curtilage. The vehicular access to the development is to be provided from Cairnbrook residential estate to the west, including associated works to facilitate same. A vehicular entrance is also proposed from Springfield Lane to access the house proposed on the northern part of the site. Pedestrian and cycle links are proposed to Springfield Lane to the north (also providing a secondary emergency vehicular access) and to the permitted development (Reg. Ref.: PC/H/01/19) at Rockville Drive / Glenamuck Cottages to the south-west, and the proposal includes for the provision of infrastructure up to the application site boundary to facilitate future connections to adjoining lands to the north, east and south. Bike stores, apartment stores, childcare facility store, bin stores, plant rooms, ESB Substation and block cores are located at the undercroft and ground floor levels of the apartment buildings. The proposal includes free-standing bike and bin stores adjacent to the duplex / apartment units and mid-terraced houses. The proposed development includes private amenity space, consisting of balconies / terraces for all apartments and duplex / apartments and private gardens for the houses, public and communal open space, including children’s play areas and an ancillary play area for the childcare facility, PV panels at roof level of the apartment buildings and the houses, public lighting, and utilities infrastructure. The proposal includes all associated site and infrastructural works, including tie-ins to existing infrastructure in the Cairnbrook residential estate, foul and surface water drainage, the culverting of the on-site watercourse, attenuation tanks, hard and soft landscaping, boundary treatments, internal roads, cyclepaths and footpaths.
Cavernbell Ltd. intend to apply for Permission at this site at “The Glen”, Golf Lane, Glenamuck Road, Carrickmines, Dublin 18. The development seeks to amend the permitted apartment development (Reg. Ref. D18A/1175 / ABP Ref. 304641-19; Reg. Ref. D23A/0025). The amendment comprises the relocation of the permitted ESB sub-station/switchroom to the northern boundary of the site, with associated amendments to the permitted car-parking (no reduction in number of spaces), landscaping and open space. The remainder of the permitted development and associated site development works remain as permitted under Reg. Ref. D18A/1175 / ABP Ref. 304641-19 & Reg. Ref. D23A/0025.
Permission for a strategic housing development shall provide for the construction of (a) 118 no. residential apartment units in the form of 3 no. residential blocks of apartments ranging in height from 4 storey’s and transitioning to 6-7 storeys overall. The overall development proposal shall provide for the following: Block A (7 storeys) comprising 44 no. units (13 n0. 1 bed units, 28 no. 2 bed. units and 3 no. 3 bed units); Block B (6-7 storeys overall) comprising 38 no. units (11 no. 1 bed units, 26 no. 2 bed units and 1 no. 3 bed units); and Block C (6 storeys overall) comprising 36 units (10 no. 1 bed units; 22 no. 2 bed units and 4 no. 3 bed units); Each new residential unit has an associated area of private open space in the form of balcony / terrace area and set back upper floor levels; Open space (approx. 2,071 sqm) is provided by one major centrally located public open space (1158.4 sqm) between blocks A and B which include a play area of 63.2 sqm, two further communal open space areas are provided adjoining Blocks B (471.8 sqm) & Block C (440.8 sqm); Communal Area located at the ground floor of Block B (approx. 161.3 sqm) comprising of a shared working space (35.6 sqm), meeting rooms (42.2 sqm.), a gym (36.6 sqm) and changing/tea stations (46.7 sqm) is also proposed; 2 no. basement level areas (approx. 2,340.9 sqm) are also proposed at lower ground / ground floor level of Blocks A, B (1,470.0 sqm) and C (834.9 sqm) and include car parking, bicycle parking, refuse storage areas, plant areas and ESB Substation which is located between Block B and C; A total of 103 no. car parking spaces (67 no. at basement level and 36 no. at surface level to include 17 no. electric power points and 5 no. accessible parking spaces) are proposed. Permission and Retention Permission. The site is located on an area to the east of unit No. 13 The Court, west of No. 14 The Court, and South of no's. 21-25 The Green, Carrickmines Manor, Dublin 18. Planning permission is sought for modifications to the permitted development reg. ref. D15A/0406. These include the - Relocation of the covered bicycle stand for 10 no. bicycle parking spaces to the west of the permitted location and existing parking spaces, including all associated works to facilitate development. - Retention of the consolidated 6 no. car parking spaces as existing in the parking court.
Permission for a part Build to Rent (BtR) and part Build to Sell (BtS) Strategic Housing Development. The demolition of the existing structures at Ashwood Farm is permitted under the extant Dun Laoghaire-Rathdown County Council planning permission (Reg. Ref: DA21/0143). The development, with a total gross floor area of c.28,145 sq.m, will consist of: i.the construction of 305 residential units including; 289 Build to Rent apartments across 5 blocks (A-E) ranging in height from 6 to 7 storeys over basement incorporating: 142 1-bed and 147 2-bed apartments, all with private amenity space in the form of balconies and/or ground floor terraces; and, 16 Build to Sell three-storey 5-bedroom houses incorporating 12 semi-detached and 4 detached houses, all with private amenity space in the form of rear gardens and 2 on-curtilage parking spaces per dwelling. 1,098 sq.m of residential amenities and facilities are proposed in the BtR blocks including a resident’s gym, co-working space, meeting room, café, residents lounge, a concierge space, a parcel room, cleaner’s rooms and waste facilities; A childcare facility is proposed in Block E with a gross floor area of 489sq.m., together with a dedicated external play area of 250sq.m and 2 set-down parking spaces for drop-offs/collections; A total of 295 car parking spaces are proposed including 34 spaces for the houses comprising 32 on-curtilage parking spaces and 2 visitor parking spaces, and 261 car parking spaces are proposed to serve the apartment units (211 at basement level and 50 at surface level) including 13 universal access parking spaces and 6 car sharing spaces, 5 staff car parking spaces and 2 set-down spaces are also provided to serve the creche. 53 (20%) of the car parking spaces are to be fitted with electric vehicle (EV) charging facilities. 10 motorcycle spaces are also provided at basement level; v.520 cycle parking spaces are proposed, comprised of 428 long-stay and 80 short-stay cycle parking spaces for the residential units and 8 long-stay and 4 short-stay cycle parking spaces are proposed to serve the creche; Vehicular access will be via the existing access off the Glenamuck Road South. 2 pedestrian/cycle access points are proposed off the permitted Glenamuck District Distributor Road (ABP Ref: PL06D.303945) and 1 pedestrian/cycle access point is proposed to connect the site to the Willow Glen development; and, The development will also consist of all ancillary development works required to facilitate the development including but not limited to plant rooms, a substation, landscaping, boundary treatments, PV panels and lighting. The 289 ‘Build to Rent’ apartments will be constituted as a long-term rental housing scheme, and this planning application is accompanied by a proposed covenant or legal agreement further to which appropriate planning conditions may be attached to any grant of permission to ensure that the development remains as such. Amendment to Granted Permission under D12A/0332) a part single storey and part two storey 3-bedroom house with an extension of duration of permission granted under D12A/0332/E. The proposed revisions will include the removal of the two-storey element and a slight enlargement and reconfiguration of the single storey component to incorporate 3 no. bedrooms with elevational changes. Permission is also sought for all associated site development works.
The development seeks to retain amendments to and complete the apartment development for 48 units (20 no. 1-beds and 28 no. 2-beds) originally permitted under Reg Ref 18A/1175, ABP Ref 304641-19. The amendments include the following: Repositioning of the footprint of the permitted apartment building (and basement) on the site. Associated alterations to the permitted open space and landscaping. Increase in the overall height of the permitted building by c.1m. All other associated site development works remain as permitted including apartment numbers (48 no.), mix (20 no.1-bed and 28 no. 2-bed) and sizes, services provision, car and cycle parking numbers, bin stores, vehicular/pedestrian access and boundary treatment works.
The development consists of (i)construction of 1 no. detached two storey, three-bedroom pitched roof dwelling, (ii)the dwelling will be accessed by a new vehicular entrance, (ii) the dwelling will be served by 2 no. car parking spaces on permeable gravel paving to the front of the dwelling. Retention permission on a site 112.5sqm for alterations to the parking court. Site is located on an area to the east of unit 13 The Court west of 14 The Court and south of no's 21-25 The Green, Carrickmines Manor. Retention planning permission is sought for alterations to the parking court including the omission of a covered bicycle stand containing c.10 no. bicycle parking spaces and its replacement with hard landscaping area and consolidation of the existing car parking spaces.

The proposed development relates to removal of the existing signage associated with 'Carrickmines Park' at Glenamuck Link Road in the south-eastern corner of Quadrant 3, The Park, Carrickmines (at the entrance to Park Avenue) and the erection of two wayfinding signage installations (each comprising three steel columns) at the Glenamuck Link Road and Ballyogan Road entrances to The Park, Carrickmines. The 3-dimensional wayfinding signage structures will have a square base (0.6m X 0.6m), with modulated height (6.4m, 7.4m and 8.4m), with backlit lettering and diamond crown at top of each column. The development includes the removal and repositioning of existing fencing/hoarding lines to accommodate the proposed signage and all associated and ancillary site works.
Permission for development for proposed mixed use development for which a ten year permission is sought comprises a Gross Floor Area (GFA) of 91,288 sq.m, excluding the basement car parks, in eleven blocks varying in height from one to eleven storeys. The maximum height of the proposed development is 36.87 metres. The development will provide for 31,082 sq.m GFA of office floorspace, 3,982 sq.m GFA of retail warehousing floorspace, 7,929 sq.m GFA of retail floorspace, which includes 2 no. supermarkets (each including off-licence use) of 1,948 sq.m GFA and 2,182 sq.m GFA, 486 sq.m GFA of retail services floorspace, 1,479 sq.m GFA of leisure floorspace, 1,683 sq.m of café / restaurant floorspace, a 388 sq.m GFA childcare facility, 658 sq.m GFA of medical centre floorspace, 3,812 sq.m GFA of cinema floorspace, and 624 sq.m GFA of car showroom floorspace, along with all associated services, substation, and circulation floorspace. The development will provide for 440 no. residential apartments, to include 308 no. Build to Rent apartments, within 4 no. blocks. The proposed apartments comprise 61 no. 1 bedroom units, 60 no. 2 bedroom units, and 11 no. 3 bedroom units within Block A. The Build to Rent apartments comprise 121 no. 1 bedroom units, 170 no. 2 bedroom units, and 17 no. 3 bedroom units within Blocks B, C, and D. 1,278 sq.m GFA of resident’s amenity floorspace is located within Blocks A, B, C, and D. The development includes a series of open landscaped streets and green roofs and includes two levels of basement car parking and surface car parking to provide a total of 1,184 no. car parking spaces. The development also includes 1,190 no cycle spaces at basement level, visitor cycle parking at ground level, shower and changing facilities, circulation areas, plant areas, service yards and fire escapes. Block A is a part one to part eleven storey building over basement (level-1)/lower ground floor level and contains the following: 132 no. apartments comprising 61 no. 1 bedroom units, 60 no. 2 bedroom units, and 11 no. 3 bedroom units. The building also accommodates resident’s amenity space at lower ground, ground, and first floor levels, along with 2 no. café / restaurant units, a retail unit, and lobbies at ground floor level. External terraces are provided at first and tenth floor levels, with balconies to all elevations. Blocks B, C, and D are part three to part nine storey buildings over basement (level -1)/lower ground floor, and basement (level -2) levels, surrounding 2 no. communal courtyard open spaces and contain the following: 308 no. Build to Rent apartments comprising 121 no. 1 bedroom units, 170 no. 2 bedroom units, and 17 no. 3 bedroom units. These buildings also accommodate resident’s amenity space, a childcare facility, and waste storage areas at lower ground floor level, along with 3 no. retail units, 3 no. retail services units, and 1 no. café / restaurant unit at ground floor level, facing onto the main street. Balconies are provided to all elevations. Block E is a four storey building over basement (level -1) level, and contains the following: 3 no. café / restaurant units and office floorspace at ground floor level, with office floorspace at first to third floor levels. Blocks F and G are part two to part three storeys in height and are linked, surrounding an enclosed service yard accessed from the south, and contain the following: 2 no. supermarket units (including off-licence use), 8 no. retail units (2 no. of which include first floor / mezzanine levels), 1 no. retail warehouse unit (which includes a first floor / mezzanine level), 1 no. café / restaurant unit, and entrances to the cinema, medical centre, and leisure use at ground floor level. A leisure unit and medical centre are provided at first floor level, while a cinema (900 no. seats) is provided at first and second floor levels. Blocks H and I are six storey buildings over basement, and contain the following: 1 no. café restaurant unit at ground floor level within Block H, and a gym at ground floor level of Block I, with office space provided within both blocks from ground to fifth floors. Block K is a single storey car showroom building, located in the east of the subject site adjoining Glenamuck Road. Block J is a six storey building over basement level, accommodating office space at ground to fifth floor levels, located in the northwest of the site adjoining Ballyogan Road. This scheme includes the new Ballyogan Link Road through an extension of Northfield Road to Ballyogan Road to the north, (which is currently under construction in accordance with the permission granted under Reg. Ref: D18A/0257 and ABP Ref.: 304396-19 (subject to a separate current amendment application)). A roundabout is provided off Northfield Road which will provide a customer and servicing access and exit to / from the basement car park. The proposal provides for upgrades to Ballyogan Road, upgrades to Park Avenue and Glenamuck Link Road, including a new bus bay and pedestrian crossing along the Glenamuck Road. A vehicular entrance is proposed off the Ballyogan Link Road providing access to the basement car park via a ramp. 2 no. vehicular entrances will be provided from Park Avenue to the south (one with ramp access to the basement car park). A further 2 no. vehicular accesses are proposed from Ballyogan Road to the north. The proposed linear park is located on the northern part of the subject site, adjacent to the Ballyogan Stream, and has a total area of approximately 2.4 ha. The development includes the provision of pedestrian and cycle crossings of the Ballyogan Stream. The proposed development also includes the provision of a neighbourhood square located on the western part of the subject site. The proposal includes all hard and soft landscaping work, ESB substations, rooftop and internal plant, all associated site development works, waste management facilities, services, lighting, boundary treatments, and all other ancillary works. An Environmental Impact Assessment Report (EIAR) has been prepared and will be submitted to the Planning Authority with the planning application and the EIAR will be available for inspection or purchase at a fee not exceeding the reasonable cost of making a copy at the offices of the Planning Authority.
Permission for development. The application relates to development within the Cherrywood Strategic Development Zone (SDZ) and is subject to the Cherrywood Planning Scheme, 2014 (as amended). The development will comprise a mixed-use Village Centre and residential development as follows: 404 no. apartments (Comprising 141 no. 1-beds (ranging in size from c.45 sq.m to 61.1 sq.m), 225 no. 2-beds (raging in size from c.63 sq.m to 89.5 sq.m), and 38 no. 3-beds (ranging in size from c.90 sq.m to c.122 sq.m)) within 7 blocks ranging in height from 4 to 5 storeys and with 4 no. basement/undercroft parking areas. 41 no. houses (comprising 19 no. 3-beds and 22 no. 4-beds) ranging in size from c.1115 sq.m to c.146 sq.m. ESB sub-stations/switchrooms (totalling c.51 sq.m). Gas skid (c.4.8 sq.m). 11 no. waste storage areas (totalling c.401 sq.m). 7 no. plant areas (totalling c.516.70 sq.m). Provision of a new public park and a park/greenway along the Carrickmines Stream. Provision of an acoustic barrier along the southern/south-western edge of the site adjacent the M50. Construction of Castle Street on the subject lands and two bridges across the Carrickmines Stream, one to serve the future school site, the second to provide pedestrian and cyclist access to the Carrickmines Luas station and future Transport Interchange and adjoining 3rd party development lands to the north. In accordance with Section 7.2.2 of the Cherrywood Planning Scheme, 2014 (as amended) it is proposed to utilise an existing Right of Way to the west of the application site, to facilitate construction access to/from Glenamuck Road North Roundabout for an interim period until such time as the remainder of Castle Street (on third party lands to the east of the application site) is completed and becomes available for construction and operational traffic. The proposed development includes for all associated site development works, landscaping, boundary treatments and services provision. The total gross floor area of the proposed development is c.48,606 sq.m with c13.058 sq.m of basement/undercroft parking area. An Environmental Impact Assessment Report (EIAR) has been prepared in respect of the proposed development.
Permission for development. The development will principally consist of the demolition of the existing dwelling (98sq m) and the construction of a part-6 to part-8 No. storey over basement residential development (7,213 sq m) comprising 72 No. units (14 No. studios, 16 No. 1 beds, 40 No. 2 beds and 2 No. 3 beds), all with associated balconies/terraces facing north, south, east and west. The development will also include the upgrading of the site entrance from Golf Lane to the south-east of the site; a pedestrian access from Glenamuck Road; 56 No. car parking spaces; bicycle parking; bin store; boundary treatments; hard and soft landscaping; plant; photovoltaic panels; green roofs; sub-station; lighting; and all other associated site works above and below ground.
The proposed development comprises a residential development of 482 no. units (all apartments), along with ancillary residential amenities, and provision of a childcare facility, gym, and local shop. The proposed residential units comprise 31 no. studio units, 183 no. 1-bedroom units, 229 no. 2-bedroom units, and 39 no. 3-bedroom units (including 2 no. duplex type units). The proposed development is set out in 7 no. blocks which comprise the following: • Block A1 comprises 62. no, apartments within a part four, part six storey building, including 10 no. studio units, 7 no. 1-bedroom units, 41 no. 2 bedroom units, and 4 no. 3-bedroom units. An ESB substation is provided at ground floor level. • Block A2 comprises 85 no. apartments within a part four, part eight storey building, including 25 no. 1-bedroom units, 45 no. 2-bedroom units, and 15 no. 3-bedroom units. • Block A3 comprises 79 no. apartments within a part four, part twelve storey building, including 21 no. studio units, 19 no. 1-bedroom units, 28 no. 2-bedroom units, and 11 no. 3-bedroom units. • Block B0 comprises 150 no. apartments and resident’s amenities within a part four, part eighteen, part twenty-one and part twenty-two storey building. The apartments include 76 no. 1-bedroom units, 68 no. 2-bedroom units, and 6 no. 3-bedroom units (including 2 no. duplex type units). An ESB substation, resident’s concierge area and amenity space (171 sq.m sq.m) are provided at ground floor level. A further resident’s amenity / event space is provided at the twentieth and twenty-first floor levels (83 sq.m). • Block B1 comprises 8 no. apartments and is four storeys in height, directly abutting Block B0. The apartments include 4 no. 1-bedroom units, and 4 no. 2-bedroom units. • Block C comprises 42 no. apartments and a local shop within a part five, part seven storey building. The apartments include 30 no. 1-bedroom units, 9 no. 2-bedroom units, and 3 no. 3-bedroom units. A local shop (154 sq.m) and an ESB substation are provided at ground floor level. • Block D comprises 56 no. apartments, a commercial gym, resident’s concierge area, resident’s lounge, and a childcare facility in a part four, part seven storey building. The apartments include 22 no. 1-bedroom units, and 34 no. 2-bedroom units. The resident’s concierge area (99 sq.m), commercial gym (340 sq.m), and childcare facility (300 sq.m) units are located at ground floor level. The resident’s lounge (292 sq.m) is located at first floor level. Two basement levels are proposed, providing car parking spaces (299 no.), bin stores, plant rooms, bicycle parking (1,000 no. spaces), and circulation areas. A further 240 no. bicycle parking spaces and 4 no. car parking spaces are provided at ground level. The proposed development includes landscaping, boundary treatments, public, private and communal open space (including roof terraces), two cycle / pedestrian crossings over the stream at the western side of the site, along with a new pedestrian and cycle crossing of Glenamuck Road South at the west of the site, cycle and pedestrian facilities, play facilities, and lighting. The proposed buildings include the provision of private open space in the form of balconies and winter gardens to all elevations of the proposed buildings. The development also includes vehicular, pedestrian, and cycle accesses, drop off areas, boundary treatments, services, and all associated ancillary and site development works. Part of the site (along Golf Lane) falls within the area of the Cherrywood Strategic Development Zone (SDZ) which is subject to the Cherrywood SDZ Planning Scheme 2014, as amended. The application contains a statement setting out how the proposal will be consistent with the objectives of the Dún Laoghaire-Rathdown County Development Plan 2016 – 2022, the Ballyogan and Environs Local Area Plan 2019-2025, and the Cherrwood SDZ Planning Scheme 2014, as amended. An Environmental Impact Assessment Report has been prepared in respect of the proposed development and accompanies this application. The application contains a statement indicating why permission should be granted for the proposed development, having regard to a consideration specified in Section 37(2)(b) of the Planning and Development Act, 2000, as amended, notwithstanding that the proposed development materially contravenes a relevant development plan or local area plan other than in relation to the zoning of the land.
